These Terms of Service ("Terms") govern your access to and use of the BookedMedSpas.com website and any services we provide ("Services"). By using the site or engaging our Services, you agree to these Terms.
1. Nature of Service
BookedMedSpas.com provides AI automation services — including AI chatbots, AI voice agents, and automated follow-up sequences — designed to help med spas acquire new clients. The exact scope of services for any client engagement is defined in a separate client agreement.
2. No Guarantee of Results
While we work diligently and apply industry best practices, we do not guarantee any specific number of bookings, leads, revenue, return on ad spend, or other business outcomes. Performance depends on numerous factors outside our control, including market conditions, your offer, pricing, location, staff, and responsiveness to leads.
3. Client Responsibilities
- Provide accurate business information, brand assets, and access required to operate the Services.
- Maintain the licenses, certifications, insurance, and legal compliance required for your business.
- Respond promptly to qualified leads and appointments generated by the Services.
- Comply with all applicable advertising rules and platform policies (including those of Meta, Google, and others).
- Refrain from making medical, therapeutic, or efficacy claims that violate applicable law.
4. Payment Terms
Specific pricing, billing cycles, refund policies, and cancellation terms are set out in your client agreement. In general, fees are billed in advance and are non-refundable for work already performed. Failure to pay may result in suspension or termination of the Services.
5. Intellectual Property
All proprietary frameworks, software, automations, voice agent configurations, ad creative templates, and methodologies developed by BookedMedSpas.com remain our exclusive property. You receive a non-exclusive, non-transferable license to use the work product produced for your business solely while your engagement is active.
You retain ownership of your brand assets, content, and any data submitted by you or generated about your business through use of the Services.
6. Third-Party Platforms
The Services rely on third-party platforms (such as Meta, Google, and communications providers). We are not responsible for changes, outages, policy enforcement, or account actions taken by those platforms.
7. Limitation of Liability
To the maximum extent permitted by law, BookedMedSpas.com, its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost data, arising out of or related to your use of the Services. Our total aggregate liability for any claim arising from these Terms or the Services shall not exceed the amount paid by you to us in the three (3) months preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless BookedMedSpas.com from any claims, damages, or expenses arising from your business operations, the services you provide to your clients, or your violation of these Terms or applicable law.
9. Termination
Either party may terminate an engagement according to the cancellation terms in the client agreement. We reserve the right to suspend or terminate access to the Services for breach of these Terms or for conduct we determine, in our sole discretion, to be harmful.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. The exclusive venue for any disputes shall be the state or federal courts located in California.
11. Changes to These Terms
We may update these Terms from time to time. The "effective date" above will reflect the most recent revision. Continued use of the Services constitutes acceptance of the updated Terms.
